In these terms, “we”, “us” and “our” refer to SAUCE & SPICE (UK) LTD. “You” and “your” refer to the person using this website or placing an order. These terms apply alongside any specific information shown for an item or during the ordering process.

01About these terms

This website provides information about our takeaway food menu and, where ordering functionality is available, enables customers to place food orders for collection or eligible local delivery.

By using the website, you agree to use it lawfully. When you place an order, the terms in force at that time, together with the relevant menu details and order information, form the basis of the order agreement.

If any item-specific information differs from a general description in these terms, the item-specific information will apply to that item where appropriate. Nothing in these terms removes any consumer right that cannot lawfully be excluded or restricted.

02Using this website

You agree to provide accurate and complete information when placing an order, including contact details and any information needed to fulfil your selected collection or delivery option.

You must not:

  • Use the website for unlawful, fraudulent or misleading purposes.
  • Submit information that you know is false or materially inaccurate.
  • Attempt to interfere with the operation, security or proper functioning of the website.
  • Use automated methods to disrupt the website or collect information without permission.

We may take reasonable steps to protect the website, customers and business operations where misuse or suspicious activity is identified.

03Menu and food information

Menu descriptions are provided to help you understand the food offered. We aim to keep descriptions, ingredients information and item details accurate and up to date.

Food is prepared in a working kitchen, and appearance, presentation or garnish may vary. Such variation does not permit us to supply food that materially differs from its description or fails to meet applicable legal requirements.

Menu items may change, and an item may be unavailable at certain times. We will not knowingly accept an order for an item that we cannot supply without taking appropriate steps to explain the issue and agree any suitable resolution with you.

Please check before ordering. If you need clarification about an ingredient, portion, preparation method or dietary requirement, contact us before placing the order. Do not rely on a general category label alone to determine whether a dish is suitable for you.

04Allergens and dietary needs

Food allergen information is important. Information about relevant allergens must be made available in accordance with applicable food law. Please review the allergen information provided for an item before ordering and contact us if anything is unclear.

If you have a food allergy, intolerance or other dietary requirement, tell us clearly before your order is prepared. We will use the information available to respond to your enquiry, but we can only confirm suitability after the relevant ingredients and preparation arrangements have been checked.

Ingredients, recipes and preparation arrangements may change. Food may also be handled in a kitchen where different ingredients are present. We will communicate relevant allergen and cross-contact information as required, but you should not assume that an item is allergen-free unless this has been specifically and reliably confirmed.

We do not guarantee that every requested modification can be accommodated. If we cannot confidently confirm that a dish is suitable for your stated allergy or dietary need, we may explain that we cannot fulfil the request.

For food safety, please raise allergen questions before completing your order and check any relevant information supplied with the food when it is received.

05Orders and confirmation

Before submitting an order, check the selected items, quantities, any available options, your contact details and the collection or delivery information.

An order submission or an automated acknowledgement may confirm that your request has been received, but it does not necessarily mean that the order has been accepted. Acceptance will be indicated through the confirmation provided by the website or communicated by us.

If we cannot accept or fulfil an order, for example because an item is unavailable or essential order information is missing, we will take reasonable steps to contact you and explain the available options.

Please retain your order confirmation or reference, if one is provided, so that you can identify the order if you need to contact us.

06Prices and availability

Prices are displayed in pounds sterling (£) unless clearly stated otherwise. The applicable item prices and any disclosed additional charges will be shown during the ordering process before you submit your order.

We take reasonable care to ensure that displayed prices and menu details are accurate. If we identify a material error before accepting an order, we may contact you to clarify the correct details. We will not treat an order as accepted on the basis of a materially incorrect price without resolving the issue appropriately.

Availability can change due to ingredient supply, preparation capacity or other operational circumstances. Where an item becomes unavailable after an order is placed, we will contact you where reasonably possible to discuss an appropriate solution.

07Preparation and substitutions

Food is prepared in line with the order details and the information provided for the relevant menu item. We aim to prepare orders with reasonable care and to supply food that matches its description and applicable food safety requirements.

We will not make a material substitution to an ordered item without seeking your agreement where agreement is required. If a suitable alternative cannot be agreed, we will explain the available options, which may include removing the unavailable item and providing an appropriate refund where applicable.

Requests for extra ingredients, removals, special preparation or other modifications are subject to the options offered and our ability to fulfil them safely. A request is not confirmed unless we have accepted it.

08Collection and delivery

Collection and local delivery options depend on what is available for the particular order. Delivery may be limited by address, operational capacity or other conditions displayed during the ordering process.

Any collection time, estimated delivery time or other fulfilment estimate is an estimate unless expressly confirmed as a guaranteed time. Preparation and delivery can be affected by order volume, traffic, weather, ingredient availability and other circumstances outside our reasonable control.

For collection orders, please use the collection instructions provided with your confirmation. For delivery orders, provide an accurate address and contact details and make reasonable arrangements to receive the order.

If there is a problem with access, contact details or delivery instructions, we may need to contact you to agree what can reasonably be done. Any additional steps or charges will be handled in accordance with the information disclosed for the order and applicable law.

If we cannot fulfil an accepted order, we will contact you where reasonably possible and provide an appropriate resolution in accordance with your legal rights.

09Changes and cancellations

If you need to change or cancel an order, contact us as soon as possible and provide the order reference, if available. Whether a change can be made depends on the stage of preparation, the type of request and the circumstances of the order.

We will make reasonable efforts to consider a request, but changes may not be possible once food preparation has begun or the order has been dispatched. A request is not confirmed until we have agreed to it.

Freshly prepared food and other perishable goods may be subject to exceptions from certain statutory cancellation rights. The application of any exception depends on the relevant legal requirements and the circumstances of the order. This does not remove your rights where food is faulty, unsafe, not as described or otherwise fails to meet legal requirements.

If we cancel an accepted order or cannot supply an item, we will explain the available options and arrange any refund due in accordance with the applicable law and our Refund Policy.

10Incorrect or unsatisfactory orders

Please check your order when it arrives or when you collect it, where reasonably practical. If an item is missing, incorrect, damaged, unsafe or materially different from what you ordered, contact us promptly so we can investigate.

Please provide your order reference, a description of the issue and, where useful, photographs or other relevant information. This helps us identify what happened and determine an appropriate resolution.

If you have a food safety concern, do not consume food that you reasonably believe may be unsafe. Contact us with the details as soon as possible. If you believe you are experiencing a serious allergic reaction or other medical emergency, seek emergency medical assistance immediately.

We will consider the circumstances and your applicable consumer rights when assessing an issue. We may ask reasonable questions to establish what happened, but you do not lose statutory rights simply because you cannot provide a particular type of evidence.

11Refunds and remedies

Refunds and other remedies are considered according to the circumstances, the nature of the issue and applicable consumer law. A refund may be appropriate where an accepted order cannot be supplied, an item is missing or incorrect, or the food does not meet the applicable legal requirements.

Where a refund is due, we will explain the relevant arrangement and process it through the original transaction route where practicable and lawful. If that is not possible, we will contact you to agree an appropriate alternative. The time for the funds to appear may depend on the relevant financial institution or service provider.

A change of mind after food has been prepared does not automatically entitle a customer to a refund. However, this does not restrict any cancellation right or remedy that applies under law, or any refund we agree to provide in the circumstances.

Further information is available in our Refund Policy. If that policy and these terms appear inconsistent, we will interpret them consistently with applicable law and your statutory rights.

12Website content and availability

We aim to keep the website accessible and its content accurate, but we cannot guarantee uninterrupted access or that every feature will always be available. Maintenance, technical faults or circumstances beyond our reasonable control may occasionally affect the website.

We may update menu descriptions, images, prices, website features or other content as our business and menu change. Changes to the website do not alter the terms of an order that has already been accepted, except where a change is agreed with you or otherwise permitted by law.

Photographs are provided as a visual guide. Unless expressly stated otherwise, presentation may vary from the image shown. Images do not override the written description of an item or any legally required product information.

13Liability and legal rights

Nothing in these terms excludes or limits liability where doing so would be unlawful. This includes liability that cannot legally be excluded for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that the law does not permit us to exclude or restrict.

We remain responsible for the legal obligations that apply to the food we supply, including applicable requirements relating to food safety, description and quality. Nothing in these terms is intended to remove or reduce your rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

To the extent permitted by law, we are not responsible for losses that could not reasonably have been anticipated when the relevant order was made or for circumstances beyond our reasonable control. This paragraph does not affect your right to an appropriate remedy where we fail to meet a legal obligation.

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent that they can lawfully do so.

14Privacy and cookies

15Complaints and contact

If you have a question or complaint about an order, please contact us and provide enough information for us to identify the issue. We will review the information available and respond as reasonably practicable.

For order-related matters, please include your order reference, the date of the order if known, the item concerned and a clear description of the issue. For allergen or food safety concerns, please identify the relevant dish and explain the concern as clearly as possible.

16Governing law

These terms are governed by the laws of England and Wales, except where mandatory consumer protection rules require otherwise. If you are a consumer living in another part of the United Kingdom, you may also benefit from mandatory protections available under the law applicable to your place of residence.

Any dispute will be dealt with by the courts that have jurisdiction under applicable law. Nothing in this section limits any rights you may have as a consumer to bring proceedings in a court that is legally available to you.
